Please read these terms carefully before using our services. These terms govern your use of 8GIG Konstruct's construction, generator set, and air conditioning services.
Introduction
Welcome to 8GIG Konstruct Inc. (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, services, and any other interactions with 8GIG Konstruct Inc., a licensed construction company based in Metro Manila, Philippines.
By accessing our website, using our services, or engaging with us in any capacity, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Acceptance of Terms
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and 8GIG Konstruct Inc.
If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
Our Services
8GIG Konstruct Inc. provides the following services:
- Construction Services: General construction, building, and renovation projects
- Generator Set Services: Installation, maintenance, and repair of generator systems
- Air Conditioning Services: Installation, maintenance, and repair of HVAC systems
- Electrical Works: Electrical installation, maintenance, and repair services
- Mechanical Works: Mechanical system installation and maintenance
- Project Management: Planning, coordination, and execution of construction projects
All services are provided in accordance with applicable Philippine laws, regulations, and industry standards.
Service Agreements
Specific terms for each project will be detailed in separate service agreements, contracts, or work orders. These documents will include:
- Project scope and specifications
- Timeline and milestones
- Pricing and payment terms
- Warranty and guarantee terms
- Change order procedures
- Safety requirements and compliance
In case of conflict between these Terms and specific service agreements, the service agreement shall prevail for that particular project.
Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information about your project requirements
- Obtain necessary permits, licenses, and approvals from relevant authorities
- Ensure safe and accessible work areas for our personnel
- Make timely payments as specified in service agreements
- Comply with all applicable laws and regulations
- Provide necessary utilities and access to the work site
- Notify us immediately of any changes to project requirements
Payment Terms
Payment terms will be specified in individual service agreements. Generally:
- Payment schedules will be based on project milestones or completion phases
- Late payments may incur additional charges as specified in service agreements
- We reserve the right to suspend work for non-payment
- All prices are subject to change due to material cost fluctuations or scope changes
- Additional work requested beyond the original scope will be billed separately
Payment methods accepted include bank transfers, checks, and other methods as agreed upon in service agreements.
Warranty and Guarantees
We stand behind our work and provide the following warranties:
- Workmanship Warranty: 1-2 years on workmanship, depending on the service type
- Material Warranty: As provided by manufacturers and suppliers
- Compliance Warranty: All work performed in accordance with applicable codes and standards
- Performance Warranty: Systems will perform as specified in service agreements
Warranty claims must be reported promptly and in writing. We will repair or replace defective work at no additional cost during the warranty period.
Limitation of Liability
To the maximum extent permitted by law:
- Our total liability shall not exceed the total amount paid for the specific service
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for delays caused by factors beyond our control
- Client assumes responsibility for any modifications made after project completion
- We are not liable for damages resulting from client's failure to follow maintenance instructions
This limitation does not apply to gross negligence, willful misconduct, or violations of applicable law.
Intellectual Property
All intellectual property rights in our designs, plans, and proprietary methods remain our property unless otherwise specified in writing. You may not:
- Copy, modify, or distribute our designs without permission
- Use our intellectual property for competitive purposes
- Reverse engineer our proprietary methods or systems
- Claim ownership of our intellectual property
Client retains ownership of their property and any intellectual property they provide to us.
Safety and Compliance
We are committed to maintaining the highest safety standards:
- All work performed in accordance with Philippine safety regulations
- Our personnel are properly trained and certified
- We maintain appropriate insurance coverage
- We follow industry best practices and safety protocols
- We comply with all applicable building codes and regulations
Clients must provide a safe working environment and comply with all safety requirements we specify.
Termination
Either party may terminate service agreements under the following circumstances:
- Breach of Contract: Material breach of service agreement terms
- Non-Payment: Failure to make payments as specified
- Safety Violations: Unsafe working conditions that cannot be resolved
- Mutual Agreement: Both parties agree to terminate
- Force Majeure: Events beyond either party's control
Upon termination, payment is due for all work completed and materials provided. We will provide a final invoice within 30 days of termination.
Dispute Resolution
We encourage resolving disputes through direct communication. If disputes cannot be resolved amicably:
- Disputes will be resolved through binding arbitration in Metro Manila
- Arbitration will be conducted in accordance with Philippine arbitration rules
- Each party will bear their own legal costs unless otherwise determined
- Judgment on arbitration awards may be entered in any court of competent jurisdiction
This dispute resolution clause does not prevent either party from seeking injunctive relief in court.
Force Majeure
Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including:
- Natural disasters (earthquakes, typhoons, floods)
- Government actions or regulations
- War, terrorism, or civil unrest
- Pandemic or public health emergencies
- Labor strikes or material shortages
- Utility failures or infrastructure problems
Affected parties must notify the other party promptly and make reasonable efforts to mitigate the impact of force majeure events.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal proceedings shall be conducted in the courts of Metro Manila, Philippines.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. We will notify clients of material changes by:
- Posting updated Terms on our website
- Sending email notifications to existing clients
- Including notice in service agreements for new projects
Continued use of our services after changes constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. We will replace invalid provisions with valid ones that achieve the same purpose.
